December 18, 1962, appellant (plaintiff), an inmate of the state penitentiary, filed in the district court, in and for Ada county, a petition for writ of habeas corpus. In his petition he alleged that his imprisonment was illegal in that the judgment of conviction and commitment was void because he had been “deprived of his right to be represented by counsel,” and that upon his arraignment he had not been advised of his “right to counsel or of the nature of the charges against him,” and that because of illness, injury and emotional disturbance he was at the time “wholly…
