Defendant-appellant Curt R. Mueller (“Mueller”) was found guilty by a jury of domestic violence with specifications for physical harm and a previous conviction for domestic violence. 1 The victim in the case was Elaine Bennett (“Bennett”). Mueller and Bennett, who were not married, lived together in a house at 4148 O’Leary Avenue. This house was titled in both their names jointly, with fight of survivorship.

The only aspect of the case before this court on appeal is the sentence, not the adjudication of guilt. Mueller was sentenced to three to five years’ incarceration with credit for time…
