This MATTER is before the Court on Defendant Royal Caribbean Cruises, Ltd.’s (“RCL”) Motion to Dismiss Counts Four and Five of the Amended Complaint [D.E. 38], Plaintiff Jane Doe No. 8’s (“Doe”) *1338Response [D.E. 48], and RCL’s Reply [D.E. 53].
