Defendant James Earle, Sr. is a licensed emergency medical technician (EMT) who owns and operates Earle’s Ambulance Service, a private, unincorporated ambulance service licensed by the State of Maine and operated in the Town of Kittery. Defendants Susan Keene and James Earle, Jr., also licensed EMTs, are employees of the business. On January 19, 1982, pursuant to regulations promulgated under the authority of 32 M.R.S.A. §§ 71-75 (1978) repealed and replaced by P.L. 1981, ch. 661, §§ 1, 2 (effective July 13, 1982), the Department of Human Services (DHS) filed a statement of…
