SUMMARY ORDER

Plaintiff-Appellant Todd C. Bank appeals from the May 27, 2009, 2009 WL 1491227, Memorandum, Order & Judgment of the District Court for the Eastern District of New York (Weinstein, J.) granting summary judgment to defendants. We assume the parties’ familiarity with the facts and procedural history of the case.
