Twelve construction workers filed this putative class action against Walsh Construction Company (“Walsh”), alleging that Walsh discriminates against black employees in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. (“Title VII”), and the Civil Rights Act of 1866, 42 U.S.C. § 1981, as amended. Before the court is plaintiffs’ motion to certify four classes under Federal Rule of Civil Procedure 23(b)(2) and (b) (3).
