Appellant, Patrick Cain, was convicted of conspiracy to commit ar*511son and attempted criminal mischief following trial before a jury in the Sixteenth Judicial District. We affirm.
The Crossroads Inn (Inn) in Miles City, Montana, was destroyed by fire on the morning of October 20, 1984. Jack Holmes, who lives near the Inn, was awakened by smoke around 4:00 that morning. After driving over to the Inn, he saw heavy smoke coming from the kitchen area.
