On the trial of this cause at Nisi Prius, several questions of law were raised and discussed by the counsel concerned; upon which it became necessary for the learned judge, before whom the cause was tried, to instruct the jury. His instruction to the jury on these questions has been excepted to by the counsel for the defendants, and, among other matters, assigned by them as reasons for a new trial.
