Applied Plastics, Inc., and its insurer, U.S. Fire Insurance Company, (collectively, Applied Plastics) appeal from a judgment affirming an order of the Labor and Industry Review Commission (LIRC). LIRC had reversed the findings and order of the hearing examiner and awarded maximum death benefits to the guardian of the minor child of Henry Klein, Jr. (Klein). LIRC concluded that at the time of his death Klein was performing services growing out of and incidental to his employment, within the purview of the Worker’s Compensation Act.
