In December, 1910, tbe appellee Lee, and tbe appellant warehouse company entered into a verbal contract by wbicb the warehouse company was to advance Lee, who was a tobacco buyer and trader of large experience, living in Lewis county, money for the purpose of enabling him to purchase tobacco and ship> the same to the warehouse company for sale at its warehouse in Louisville, Ky.
