The lands from which the timber involved ini this action was taken were subject to the lien of a judgment which had been *460assigned to plaintiff, and upon which they were, on April 23, 1883, sold to him on execution, a certificate of sale being duly executed and recorded. At the time of the sale they were unoccupied, and valuable only or principally for the pine timber standing upon them.
