Woodside, J.,. This is. an appeal by the Commonwealth from an order of the Court of Quarter Sessions of Chester Coufíty vacating á sentence to pay the costs of a criminal prosecution; The sentence' had been imposed upon k defendant after a jury had found him not guilty of the misdemeanor with which he was charged, but had directed him to pay the costs of prosecution.

*297The defendant was charged with wantonly pointing and discharging a firearm in violation of The Penal Code of June 24, 1939, P. L. 872, §716, 18 P.S. §4716.
