In this action, the appellee sued the appellant, in a complaint of three paragraphs, upon a promissory note, of which the following is a copy:

“ $500.00. Terre Haute, Ind., December 13th, 1870.
“ One year after date, I promise to pay to the order of Charles Yung fife hundret dollars, value received, without any relief from valuation or appraisement laws, with 10 per cent.
