This is an appeal from the Circuit Court for Carroll County and was taken from an order refusing to grant a writ of man- damns, which had been asked for by the appellant against the appellee. The facts which are necessary to be stated are as follows. By ch. 88 of the Acts of the General Assembly of 1876, it was provided that the Mayor and Common Council of Westminster may levy annually a tax not exceeding five cents on every $100 to be used and applied to the payment of water rents for the use of water for the public uses of said city, that is to say; for use on the public streets of said…
