Appeal from circuit court. Action by Michael Meehan against William B. Morewood, as survivor, etc.,, for damages for injuries sustained. Plaintiff appeals from a judgment entered upon a dismissal of the complaint at circuit, at the close of plaintiff’s, case.

In this action the plaintiff seeks to hold the defendant liable for an assault which was committed upon the plaintiff by a person in the employ of the defendant’s Arm. The defendant and William Donaldson, now deceased, carried on business as warehousemen in the city of Hew York. The plaintiff was a truckman, engaged in the cartage business, and employing a number of men under him. In April, 1885, he was directed by Mr. A.
