This suit was commenced by the appellee against the appellant, before a justice of the peace of Tipton county. Before the justice the appellee recovered judgment for the sum of twenty-four dollars and costs; from which judgment an appeal was taken by the appellant to the circuit court of the county. There the cause was tried by a jury, and a verdict was returned for the appellee in the sum of fifty dollars; and over ajipellant’s motion for a new trial the court rendered judgment on the verdict.
