Prior to April 23, 1927, plaintiffs had furnished to the American Academy of Astrology, Inc., hereinafter called the Academy, certain labor and materials and had been paid therefor by a check which was duly honored. The Academy was then also negotiating with them for the manufacture of other furniture and for other work to be done upon its property, but was not able to pay cash therefor and plaintiffs were not willing to extend credit for the amount involved.
