Affirming.

The city of Louisville began this proceeding against Dr. W. E. Baxter to condemn, for wharf purposes, a tract of land containing 24.247 acres, lying on the Ohio river below Louisville. The jury fixed the value of the land at $12,123. The court entered judgment pursuant to the verdict. Dr. Baxter appeals.

The proceeding was bad under section 2831, Kentucky Statutes, which provides as follows:

“Whenever property shall be needed for appropriate municipal purposes, either within the boundaries of the city or the county, the board of public works,…
