The defendant was indicted for failure to register between August 27, 1940, and December 26, 1940, as required by the Alien Registration Act of 1940 and the regulations promulgated thereunder. He was born on March 26, 1900, in the Province of Cavite, Philippine Islands. He has never been naturalized. He contends that, as a citizen of the Philippine Islands, he became a citizen of the United States by virtue of the Treaty of Paris, signed December 10, 1898, and ratified by the United States on April 11, 1899, and therefore is not required to register under the Alien…
