The Treasurer of the State of Missouri, as custodian of the Second Injury Fund (Fund), appeals the decision from the Labor and Industrial Relations Commission (Commission) declaring the respondent, John Karoutzos, permanently and totally disabled. Under Missouri’s Workers’ Compensation Law, the Fund’s liability for compensation is predicated on § 287.220, RSMo 2000, 1 and on a decision the claimant meets the definition of the term “total disability” set out in § 287.020.7, infra.
