WEXLER, District Judge.
This is an action arising out of a business dispute between Plaintiff Cardiocall, Inc. (“Cardiocall” or the “Plaintiff Company”) and Steven Serling (“Serling”), a former employee. The action was commenced by way of an order to show cause. After granting of a temporary restraining order (the “TRO”), this court held a non-jury trial, consolidating the preliminary injunction hearing with trial on the merits.
