This action was commenced in the county court of Dawes county. The suit went to judgment and determination in that court, and was duly appealed to the district court, where plaintiff filed his petition in numbered paragraphs in'which he alleged: (1) That plaintiff was engaged in the business of manufacturer and wholesale dealer in flour, corn meal and feed, at Scribner; (2) that on or about the 13th day of March, 1908, the defendant entered into a written contract with plaintiff for the purchase by defendant from plaintiff of certain quantities of flour and corn meal of certain brands,…
