John T. Mollyneaux brought this action in the district court to recover damages of Marcus Wittenberg and his co-defendantsfor breach of a covenant contained in a deed of conveyance. In June, 1889, the plaintiff was the owner of a hotel in the city of Sutton, and the defendants were at the .same time the owners of another hotel in the same city. The parties agreed to exchange their properties, and the agreement was carried into execution.
