I. INTRODUCTION
The City of New York (“the City”) alleges that a number of gasoline makers are strictly liable for their use and handling of the gasoline additive methyl tertiary butyl ether (“MTBE”).1 Oil companies added MTBE to gasoline as an oxygenate in order to meet emissions requirements under the Clean Air Act (“CAA”) of 1990. *474MTBE gasoline has since contaminated groundwater throughout the United States.
