Plaintiff brought this action to recover for personal *131injuries and property damage resulting from an accident wherein plaintiffs car, traveling east, collided with the rear of a one-and-one-half-ton Studebaker truck, owned by defendant Sumner W. Burnham, but driven and allegedly parked unlawfully upon the highway east of York by his employee, defendant John Worman.
