The appeal herein arises upon the sustaining of a demurrer to plaintiff’s amended petition. Action was brought to recover damages for personal injuries alleged to have been sustained by reason of a defect negligently allowed to remain in a street, into which the front wheel of plaintiff’s loaded Avagon dropped and was broken, throwing plaintiff out and breaking his arm and otherwise injuring him. The basis of the demurrer is that the petition states no cause of action in that it fails to show a compliance with the Act of March 21, 1913, Laws 1913, page 545, in reference to the giving of…
