This action was brought, in the court below, by Alexander "W. Blair, against Samuel H. Allen, to recover damages for breach of a covenant of warranty in a deed. The second amended complaint alleges, that, “ In the year 1828,William B. Blair, the father of appellant, died testate, *410in Nicholas county, Kentucky, leaving surviving him his widow, Nancy, (afterwards'Nancy Allen) also appellant and one Joseph E.
