Anna R. Johnson alleges that on account of her race and in retaliation for prior complaints of discrimination, defendant reassigned her and thereby restricted her ability to train in the finance division of the Kansas City office of the United Stated Department of Agriculture (“USDA”). 1 Defendant maintains that plaintiffs claims are barred because she did not contact an Equal Employment Opportunity counselor (“EEO counselor”) within 45 days of the reassignment pursuant to 29 C.F.R. § 1614.105(a)(1).
