The plaintiff’s petition as finally amended alleged in substance, as to material facts, the following: On June 4, 1956, the plaintiff purchased a new Ford convertible automobile from the defendant who was an authorized dealer selling Ford automobiles manufactured by the Ford Motor Company on such date, and that delivery of such automobile was made on such date. “That within 90 days from the purchase and delivery date and before the said automobile had been driven or operated a distance of 4,000 miles, petitioner noticed that while the said automobile was standing in the rain,…
