OPINION
TARNOW, District Judge.
Najwa Bakal was ordered deported in absentia by a United States Immigration Court after failing to appear for her deportation hearing. The Board of Immigration Appeals (BIA) of the Immigration and Naturalization Service (INS) refused to consider Bakal’s appeal because a statute and an INS regulation establish that the exclusive means for appealing an in absen-tia deportation order is to file a motion to reopen the proceedings with the Immigration Court.
