LUNGSTRUM, District Judge.

Plaintiff William Wayne Sink filed suit against defendant Wal-Mart Stores, Inc. alleging violations of the Americans with Disabilities Act (ADA), 42 U.S.C. § 12101, et seq. Specifically, plaintiff claims that defendant refused to permit plaintiff to return to work following a medical leave of absence and ultimately terminated his employment because he had a “record of’ disability and/or because he was “regarded as” disabled.
