This is an appeal from a judgment permanently enjoining the plaintiff in error, hereinafter called defendant, from operating a beer tavern upon certain described premises in a rural area of Jackson county, Oklahoma.

Upon application of the state, on relation of the county attorney, temporary restraining order was issued, restraining operation of the tavern. By agreement this order was vacated, and the *577matter thereafter was heard again upon the petition for temporary restraining order.
