Defendant and one Eugene Gentile were jointly charged by information with the murder of John J. Driscoll, a police officer of the city and county of San Francisco. A joint trial was had which resulted in a verdict convicting defendant of murder in the first degree without recommendation. A motion for new trial and also in arrest of judgment was made and denied and judgment imposing the extreme penalty was pronounced.
