The defendants were jointly charged by information and convicted by the court of the first degree murder of Mrs. Mildred Weiss, the attempted murder of Prank Boiler, and the robberies of Boiler, Prank Muecia and Archie Bolivar. The court denied defendant Vetter’s timely motion for a separate trial. Massie then pleaded guilty, and *904both defendants waived a jury trial. Bach defendant accepted the stipulation offered by the prosecutor that his guilt and penalty trial be consolidated into one proceeding. The judge sentenced Massie to death for the murder, Vetter to life imprisonment…
