1Opinion of the CourtMaxwell, J.
This action was brought on the 19th day of March, 1887, by the defendant in error against the plaintiff in error, in the district court of Colfax county, to recover, under sections 5197 and 5198 of the Revised Statutes of the United States, double the amount of interest paid on certain usurious contracts. On the trial of the cause the court found that the defendant in error had paid to the plaintiff in error the sum of $912-^-, and that the same “ was usurious, as in said petition alleged.”
