JOSÉ A. CABRANES, Circuit Judge:
Manuel O. Adames appeals pro se from an order of the United States District Court for the Eastern District of New York (Raymond J. Dearie, Judge), dismissing Adames’s action for return of approximately $720,000 seized at the time of his arrest for attempted purchase of narcotics. The district court held, without explanation, that Adames’s complaint was untimely. In the alternative, and apparently in reference to the government’s motion for summary judgment, the court stated that “the plaintiffs allocution as part of his guilty plea resolves all material facts…
