This matter is before the Court on the Court’s Order Setting a Decertification Hearing. (Order Setting Decertification Hearing, April 1, 2008.) Michael Mario (“Plaintiff’) filed this action, on behalf of himself and a class of similarly situated individuals (“the class”), against United Parcel Service, Inc.
