David Barclay sued Mid-Century Insurance Company of Texas seeking actual and punitive damages alleging that Mid-Century breached its obligations of good faith and fair dealing. See Tex.Ins.Code Ann. art. 21.21 (West 1988 & Supp.1994). Barclay also alleged that Mid-Century violated article 21.55 of the Insurance Code by failing to accept or reject his claim within the statutory period.
