This is an appeal from an order entered in the Circuit Court of Logan County granting the motion to dismiss and motion for summary judgment filed by the appel-lee, Alan Lively, on the grounds that the action filed against the appellee was subject to a one-year statute of limitations, and that no agency relationship existed between the appellee and Seminole Coal Incorporated as a matter of law.
