I. The record situation in this case is: This petition was filed on the 21st day of February, 1927. On March 4th following, defendant entered an apPearance by his attorney, demanded a jury trial, and the case was duly assigned for trial at 9 o’clock A. M., April 4, 1927. On the latter date, the court made the following entry:
“Now on this day, case being called for trial,' plaintiff appearing by Raymond M. Hedinger, its attorney, and defendant failing to appear, is declared to be in default for want of attention. ’ ’
