PER CURIAM;,

In the trial court the Federal Deposit Insurance Corporation, as assignee of the American National Bank of Pryor, was plaintiff and E. B. Grigg was defendant. Reference will be made to the parties as they appeared in the trial court.

The American National Bank of Pryor became financially embarrassed by reason of embezzlement by one of its executives. For the protection of the depositors the assets of the bank were assigned to and taken over by the plaintiff.
