Memorandum: Defendant appeals from a judgment convicting him, following a second jury trial, of one count of official misconduct (Penal Law § 195.00 [1]). Following the first trial, County Court set aside the verdict finding him guilty of that offense based on the People’s failure to disclose Brady and Rosario material. Defendant was thereafter convicted of the same of*1660fense following the second jury trial. Defendant contends that the court erred in admitting DNA evidence at his first and second trials.
