George King filed an action in the Civil Court of Fulton County against the D. B. Thornton Company, a partnership composed of D. B. Thornton and Mrs. Lucy Bagley Thornton, and C. N. McCurdy, for $1250 damages to his automobile caused by the negligence of the defendants. McCurdy was not served and he was eliminated as a party defendant. A judge of the civil court, before whom the case was tried without the intervention of a jury, found for the plaintiff for $800 and rendered judgment accordingly.
