DUBINA, Circuit Judge:
Horace Luckey III and the other appel-lees herein seek intervention by the federal courts regarding the indigent criminal defense system of the Georgia state courts. This court has permitted the appellants in this case to appeal an interlocutory order of the district court denying renewed motions to dismiss the complaint. The district court declined to dismiss the complaint on the ground that the law of the case barred it from considering the appellants’ asserted grounds for dismissal.
