North Landers Corporation (North Landers) appealed the judgment of a Superior Court judge who up held the disapproval by the planning board of Falmouth (board) of its definitive plan for a subdivision of land in the town of Falmouth. The Appeals Court reversed the judgment of the Superior Court judge, annulled the action of the board, and directed that a further public hearing be held by the board for the purpose of taking “final action” on the plan submitted.
