In this complex, multi-year litigation, plaintiffs — Resource Investments, Inc. and Land Recovery, Inc.1 — allege that defendant has taken their property without just compensation, in violation of the Fifth Amendment of the United States Constitution. In its January 23, 2009 Opinion and Order, the court denied the parties’ cross-motions for summary judgment and set forth the unresolved substantive issues, setting the stage for trial. Res.
