J. The defendant, Alberto Torres, was convicted of murder in the first degree, on a theory of extreme atrocity or cruelty, in connection with the beating death of fourteen month old Clyde Harper, Jr., and was convicted on two indictments charging assault and battery by means of a dangerous weapon, two indictments charging assault and battery, and four indictments charging permitting bodily injury to a child (G.
