Defendant, Michael J. Seaney, appeals the trial court's order denying his motion for postconviction relief pursuant to Crim. P. 85(c). We affirm and remand for further proceedings.

Pursuant to a plea agreement, defendant pleaded guilty to first degree burglary, a class three felony, and the prosecution agreed to dismissal of numerous remaining charges. In addition, the parties agreed that defendant would be sentenced to eight years in the custody of the Department of Corree-tions (DOC) and that five years of the sentence would be suspended on the condition that he…
