Plaintiff in error, Rudolph Anderson, was indicted in the criminal court of Cook county on December 1, 1926, by a grand jury of Cook county, for the murder of Albert Gersch. The indictment charged murder by stabbing with a knife. Plaintiff in error pleaded not guilty to the indictment, and the cause was continued from time to time to June 27, 1928, when it was stricken off the calendar with leave to re-instate. On July 13, 1927, plaintiff in error was admitted to bail in the amount of $12,000. At the time the cause was stricken from the docket the sureties on plaintiff in error’s recognizance…
