This writ of error was granted to review a judgment of the criminal court of Cook county by which John Walton Winn was adjudged guilty of murder and sentenced to death.

Soon after 6:3o o’clock in the morning of December 30, 1925, John Pluskota on his way to work found the dead body of a man lying in the snow on the west side of Brandon avenue near Ninety-fourth street. The police were called and removed the body to Brown’s morgue, where it was identified as that of Albert Nusbaum.
